By accessing or using the Site, you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy and Cookies Policy (together, the “Policies”). If you do not agree, you must not use the Site.

The Site is intended for persons 18 years or older. If you access on behalf of a company or other entity, you represent that you are authorised to accept these Terms on its behalf.

We may update the Site and these Terms at any time. The “Last updated” date shows the latest version. Continued use after an update constitutes acceptance of the revised Terms.

Information on the Site is general in nature and provided for illustrative and informational purposes only. It does not constitute financial, legal, investment, or other professional advice, and does not constitute an offer to sell or a solicitation to buy any property, product, or security. You should obtain independent professional advice before making decisions.

5.1. Images, plans, dimensions, finishes, fixtures, fittings, and timelines shown on the Site are indicative and subject to change without notice due to approvals, design development, availability, and construction considerations.
5.2. All renders and imagery must be read as “Artist Impression Only”. Furniture and styling are not included unless expressly stated.
5.3. Measurements may be approximate; variations can occur during construction. Any contract of sale and the final construction documentation prevail over Site content.

Any pricing, lot availability, incentives, inclusions, or timelines displayed are subject to change and may be withdrawn at any time. Availability may be limited and not all configurations are offered at all times.

7.1. Submitting an enquiry or Expression of Interest (EOI) does not create any obligation on us to sell or allocate any property.
7.2. EOIs, reservation fees, refunds, priority, and allocation are governed by the specific EOI or Reservation Terms provided to you at the time of submission. In the event of inconsistency, those specific terms prevail.
7.3. We may request identification and other information for compliance, anti-fraud, or eligibility purposes.

You agree to:
(a) use the Site lawfully and only for its intended purposes;
(b) not attempt to access data not intended for you or circumvent security;
(c) not upload or transmit malware, automated scraping, or abusive content;
(d) not infringe intellectual property, privacy, or other rights of any person;
(e) provide accurate, current information when you contact us or submit forms.

If the Site offers user accounts, you are responsible for safeguarding your login credentials and for all activities under your account. Notify us promptly of any unauthorised use.

10.1. The Site and all content, including text, images, graphics, video, logos, trade marks, and layouts (collectively, “Content”), are owned by or licensed to Bestdream and are protected by Australian and international laws.
10.2. You may view the Site for personal, non-commercial purposes only. No Content may be copied, reproduced, adapted, distributed, or exploited without our prior written consent or the owner’s permission.
10.3. “Bestdream” and associated logos are our trade marks. You must not use them without permission.

If you send us feedback, enquiries, media, or other materials (“Submissions”), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and communicate those Submissions for the purposes of operating the Site, responding to you, and improving our services. You warrant that you have rights to your Submissions and that they do not infringe third-party rights.

The Site may link to third-party sites or use third-party tools (e.g., maps, analytics, payment processors). We are not responsible for their content, availability, or practices. Your use of third-party services is governed by those third parties’ terms and policies.

We handle personal information in accordance with our Privacy Policy and use cookies/analytics as described in our Cookies Policy. By using the Site, you consent to such handling and cookie use as set out in those Policies.

While we aim to keep the Site accurate and available, we do not guarantee:
(a) uninterrupted, timely, or error-free operation;
(b) that the Content is current, complete, or free from typographical errors; or
(c) that the Site or servers are free of viruses or other harmful components.
You are responsible for implementing appropriate security and backup measures.

15.1. Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or other rights under the Australian Consumer Law that cannot be excluded.
15.2. Subject to the ACL and to the maximum extent permitted by law, the Site and Content are provided “as is” and “as available”, without any express or implied warranties.

16.1. To the maximum extent permitted by law, Bestdream and our directors, officers, employees, and agents are not liable for any indirect, incidental, special, or consequential loss, loss of profits, loss of data, loss of goodwill, or business interruption arising from or in connection with the Site or these Terms.
16.2. Where liability cannot be excluded, and to the extent permitted by law, our total aggregate liability to you in connection with the Site is limited to AUD $100.
16.3. You acknowledge that your use of the Site is at your own risk and that property decisions require independent verification and professional advice.

You indemnify and hold harmless Bestdream from and against any claims, losses, damages, and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

We are not liable for any failure or delay due to events beyond our reasonable control, including acts of God, natural disasters, epidemics, labour disputes, supply or utility failures, or governmental actions.

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have breached these Terms or for operational or security reasons. Sections which by their nature should survive termination do survive (including Intellectual Property, Liability, Indemnity, and Governing Law).

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

If any provision of these Terms is held invalid or unenforceable, that provision will be read down or severed to the extent necessary without affecting the remaining provisions.

These Terms and the Policies constitute the entire agreement between you and us regarding the Site and supersede any prior statements or representations on the same subject matter.
